ORDER


On consideration of appellee's motion for modification of opinion and order, and the opposition thereto, it is

ORDERED that the motion for modification is granted to the extent that the last sentence of this court's opinion filed July 3, 2003, beginning "Accordingly, the order. . ." now reads:

Accordingly, the order denying the appellant's motion to vacate the dismissal is reversed and this case is remanded for further proceedings consistent with this opinion.
