Moss v. Singletary

District Court of Appeal of Florida, First District
Oct 23, 1998
735 So. 2d 496 (Fla. Dist. Ct. App. 1998)

Opinion

No. 98-1351

Opinion filed October 23, 1998.

An appeal from the Circuit Court for Walton County. Lewis R. Lindsey, Judge.

Phillip Moss, pro se, appellant.

William L. Camper, General Counsel, and Bradley R. Bischoff, Assistant General Counsel, Florida Parole Commission, Tallahassee, for appellees.

Phillip Moss petitioned the circuit court for a writ of habeas corpus, contending that the Florida Parole Commission acted improperly in revoking his parole and returning him to prison. We treat this appeal as a petition for writ of certiorari. See Sheley v. Florida Parole Commission, 703 So.2d 1202 (Fla. 1st DCA 1997), review granted, Case No. 92,260 (Fla. May 19, 1998). The petition is denied.

JOANOS, KAHN and WEBSTER, JJ., concur.
