Hearing Granted Oct. 30, 1941.

Appeal from Superior Court, City and County of San Francisco; C. J. Goodell, Judge.

Suit by Monroe L. Moss against Emily M. Moss seeking a declaration that contract executed by plaintiff and defendant and modification thereof were illegal, void and against public policy. A demurrer to complaint was sustained without leave to amend, and from a judgment in favor of defendant, plaintiff appeals.

Judgment affirmed.
