Present — Martin, P.J., Untermyer, Dore, Cohn and Callahan, JJ.


Judgment unanimously reversed and a new trial ordered with costs to the appellant to abide the event. The court should have left to the jury, as an issue of fact, the question whether the deceased was an invitee.
