IT IS STIPULATED AMONG THE PARTIES through their respective counsel as follows:

To the extent any claim set forth in the Third Amended Complaint has been ruled upon by the Court, any such ruling shall govern the Third Amended Complaint, except as to Plaintiff Thomas, who was not a party to this action when such rulings were made. As to Plaintiff Thomas, any ruling made in Thomas v. Baca, 04-8448-DDP (SHx), shall govern his claims in the Third Amended Complaint in this action.

IT IS SO ORDERED.
