ORDER

The Court REINSTATES this appeal.

On December 17, 2015, this Court ordered the trial court to make findings regarding the accuracy of the reporter's record. The trial court conducted a hearing at which counsel for the appellant; the State, and the court reporter Scott Smith were present.

We ADOPT the findings that: (1) Mr. Smith could produce his notes from the April 20, 2015 trial; (2) the reporter's record that was filed on July 6, 2015 did not accurately reflect the April 20, 2015 proceedings; and (3) the corrected record that was filed on December 1, 2015 accurately reflected the trial proceedings. The appeal will now proceed.
