Oct 9, 1979
375 So. 2d 619 (Fla. Dist. Ct. App. 1979)

Opinion

No. 79-447.

October 9, 1979.

Appeal from Circuit Court, Dade County; Donald E. Stone, Judge.

Arthur J. Morrison, in pro. per.

Taylor, Brion, Buker Greene and Mario Velez, Miami, for appellee.

Before HAVERFIELD, C.J., SCHWARTZ, J., and MELVIN, WOODROW M. (Ret.), Associate Judge.

Plaintiffs appeal from the final summary judgment of foreclosure entered in favor of Great American Federal Savings and Loan Association in its suit against Arthur J. Morrison and Abigail K. Morrison, his wife.

We reverse. The appellee failed to demonstrate the absence of genuine issues of fact and was not, under the record in this case, entitled to the entry of said judgment. Holl v. Talcott, 191 So.2d 40 (Fla. 1966).

Reversed for further proceedings consistent with this opinion.
