Appeal from the District Court of Pottawatomie County; J. Knox Byrum, Judge.

Action by Rayford Morris, plaintiff, against Paul Wise and Albert General McFarland, defendants, to recover damages for personal injuries. From an order of the trial court sustaining the separate demurrer of Paul Wise, and dismissing the action, plaintiff appeals. Affirmed.

This is a companion case to Morris v. Wise, Okla., 293 P.2d 547 and the allegations of the petition in each case are identical with the exception of certain items of damage. The syllabus in the former case is adopted as the syllabus in this case, and the judgment is affirmed.
