Judgment, and order amending it, reversed upon the law and the facts and a new trial granted, costs to appellant to abide the event. We are of opinion that the testimony presented on behalf of plaintiff made out a prima facie case in his favor. Lazansky, P.J., Young, Kapper, Seeger and Scudder, JJ., concur.
