Morogianis v. Tres, Inc.

Appellate Division of the Supreme Court of New York, First Department
Jun 13, 1996
228 A.D.2d 279 (N.Y. App. Div. 1996)

Opinion

June 13, 1996

Appeal from the Supreme Court, New York County (Alice Schlesinger, J.).

The record conclusively establishes plaintiff's claim that the scaffold from which plaintiff-construction worker fell lacked the requisite safety devices and that such statutory violation was the proximate cause of his injuries. Accordingly, the motion court properly granted plaintiff's motion for partial summary judgment on the issue of liability ( Robinson v. NAB Constr. Corp., 210 A.D.2d 86).

Concur — Rosenberger, J.P., Wallach, Nardelli and Tom, JJ.
