CONTINUING ORDER OF ABATEMENT

On May 16, 2024, this Court abated this appeal and referred the appeal to mediation. On July 8, 2024, the parties filed a Joint Status Report and Request for Continued Abatement, stating that the parties had agreed to a mediator and anticipated that mediation would be completed by August 16, 2024. Accordingly, the parties requested that the Court continue to abate this appeal to allow the parties to complete mediation.

We direct the parties, no later than 90 days from the date of this order, to file another status report advising the Court of the status of mediation. If the parties do not respond as directed, the appeal may be reinstated on the Court's active docket and proceed under the applicable Texas Rules of Appellate Procedure.

The appeal remains abated, treated as a closed case, and removed from this Court's active docket.

It is so ORDERED.
