This case is currently calendared for trial at the Session of the Court commencing on April 2, 2024, in Charleston, West Virginia; the trial session is to be conducted remotely. On March 11, 2024, respondent filed a Motion to Dismiss for Failure to Properly Prosecute. By Order served on the parties on March 13, 2024, the Court ordered petitioner to show cause in writing, on or before March 27, 2024, why this case should not be dismissed for failure to properly prosecute. On March 25, 2024, the parties filed a Proposed Stipulated Decision that resolves all issues in this case. Upon due consideration, it is hereby

ORDERED that the Court's Order to Show Cause, served on the parties on March 13, 2024, is discharged. It is further

ORDERED that respondent's Motion to Dismiss for Failure to Properly Prosecute, filed March 11, 2024, is denied as moot.
