In their appellate briefs, both parties contend that appellant Tiffany Moreno moved for traditional summary judgment on her quiet title claim, citing generally to Tiffany Moreno's Motion for Traditional Summary Judgment found at Clerk's Record 950.

The Court has reviewed Tiffany Moreno's Motion for Traditional Summary Judgment. The motion appears to address only appellee's claim seeking a declaratory judgment for foreclosure. For example, the first paragraph of the motion states that Tiffany Moreno "files this Traditional Motion for Summary Judgment on the claim for declaratory judgment for foreclosure filed by" appellee. Additionally, Tiffany prayed that the trial court "dismiss with prejudice 'Count 5: Declaratory Judgment for Foreclosure' against Ms. Moreno and grant Ms. Moreno all other relief to which she is entitled, at law or in equity"; she did not pray that the trial court grant judgment in her favor on her quiet title claim.

The Court ORDERS each party file a letter brief no longer than two pages that directs the Court to the specific pages in the clerk's record where Tiffany Moreno moved for traditional summary judgment on her quiet title claim. The letter briefs shall be filed no later than May 20, 2024.
