ORDER OF DISMISSAL AND DECISION

On April 17, 2023, respondent filed a Motion to Dismiss for Lack of Prosecution. This case was called from the calendar at the May 8, 2023, Dallas, Texas trial session of the Court. There was no appearance by or on behalf of the petitioner. Counsel for respondent appeared and was heard. Upon due consideration and for cause more fully appearing in the transcript of the proceedings, it is

ORDERED that respondent's Motion to Dismiss for Lack of Prosecution, filed on April 17, 2023, is granted and this case is dismissed for Lack of Prosecution.

ORDERED and DECIDED that there is no deficiency in income tax due from, nor overpayment due to petitioner, and there are no additions to tax due from petitioner under I.R.C. §6651(a)(1), I.R.C. §6651(a)(2), and I.R.C. §6654 for the taxable year 2018.
