This case is currently set for trial at the Court's May 8, 2023, Dallas, Texas trial session. On April 17, 2023, respondent filed a Motion to Dismiss for Lack of Prosecution. Upon due consideration and for cause, it is hereby

ORDERED that, on or before the call of this case from the calendar, petitioner shall file an objection or other response to respondent's Motion to Dismiss for Lack of Prosecution, filed April 17, 2023. It is further

ORDERED that respondent's Motion to Dismiss for Lack of Prosecution, filed April 17, 2023, is set for hearing on May 8, 2023, at 10:00 a.m. in Room 726, Earle Cabell Federal Building & U.S. Courthouse, 1100 Commerce Street, Dallas, Texas 75242.

Petitioner is advised that failure to respond to respondent's Motion to Dismiss for Lack of Prosecution or to appear at the hearing on May 8, 2023, may result in the Court granting respondent's motion and entering decision consistent with respondent's Motion.
