This case is calendared for trial at the Court's March 6, 2023, Houston, Texas, trial session. On February 13, 2023, respondent filed a Motion to Dismiss for Lack of Prosecution, indicating that petitioner, who is represented by counsel, has died. Respondent states that he understands there to be no objection to the granting of this Motion. Upon due consideration, it is

ORDERED that petitioner's counsel shall file, on or before March 2, 2023, a Response to the Motion to Dismiss for Lack of Prosecution in which he shall state whether there is an objection to the Court's granting of respondent's Motion. If no Response is filed by that date, respondent's Motion will be granted and the Court will enter a decision reflecting the amounts shown on the Motion.
