DECISION & ORDER ON MOTION
Appeal by Robert Rankel from an order of the Supreme Court, Kings County, dated July 2, 2012. By decision and order on motion of this Court dated September 20, 2012, the trial in the above-entitled action was stayed pending hearing and determination of the appeal on condition that the appeal was perfected on or before October 22, 2012. The appeal has not been perfected.
Now, on the Court's own motion, it is
ORDERED that the stay granted by decision and order on motion of this Court dated September 20, 2012, is vacated.
