ORDER COMPELLING RESPONSES TO DEFENDANT'S DISCOVERY REQUESTS


This matter comes before the Court pursuant to Defendant Rent-A-Center's Motion to Dismiss Or, In The Alternative, Compel Plaintiff's Responses to Defendant's Discovery Requests (Doc. 25). On December 10, 2001, Defendant served Plaintiff by mail with its First Set of Interrogatories and Requests for Production. Responses were due 30 days after receipt, on or about January 14, 2002. On February 11, 2002, Plaintiff filed a request for an extension to February 19, 2002 to respond. The Court granted the extension. Plaintiff finally provided discovery responses on March 13, 2002. Plaintiff's responses to the requests for production included no actual documents. Plaintiff responded by stating that the documents "will be produced," or referred to documents previously produced in other litigation involving the same attorneys and Defendant. Defendant has continuously objected to these responses and has requested that the documents previously produced in other litigation be identified by case name and Bates number. Although Plaintiff has supplemented his responses after Defendant filed the instant motion, Bates number and line deposition designations are still not complete. The Court will give Plaintiff twenty (20) days from the date of this Order to provide such designations and completely respond to any outstanding discovery requests by Defendant. Pursuant to Fed.R.Civ.P. 37(a)(4)(A), the Court orders Plaintiff to pay Defendant's reasonable expenses incurred in filing the instant motion, for the reasons set forth in Defendant's Brief in Support of Defendant Rent-A-Center's Motion to Dismiss or, in the Alternative, Compel Plaintiff's Responses to Defendant's Discovery Requests. Defendant shall submit an itemization of its reasonable expenses for the Court's review. If Plaintiff does not comply with this Order, the Court will consider further sanctions. Any requests to extend the discovery deadline in this case, which is currently set for June 19, 2002, shall be addressed to the Magistrate Judge.
