DECISION & ORDER ON MOTION

Motion by the appellant on an appeal from a judgment of the Supreme Court, Nassau County, entered December 14, 2010, in effect, to amend so much of a decision and order on motion of this Court dated January 20, 2011, as amended May 12, 2011, as stayed enforcement of so much of the judgment, inter alia, as conditionally committed him to the Nassau County Correctional Facility, upon the perfection of the appeal on or before June 27, 2011.

Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is

ORDERED that the appellant's motion is granted, and the decision and order on motion of this Court dated January 20, 2011, as amended May 12, 2011, is amended by deleting from the decretal paragraphs thereof the date "June 27, 2011," and substituting therefor the date "October 3, 2011"; and it is further,

ORDERED that no further enlargement of time shall be granted.
