MASTER AND SERVANT, § 65.1affirmance of judgment for plaintiff in action for commissions. In action for commissions earned on sales of roofing and siding jobs while plaintiff was employed by defendant, judgment for plaintiff was affirmed, as against claim of accord and satisfaction, on grounds that plaintiff presented sufficient evidence to sustain material allegations of complaint and that defendant failed to comply with statutory requirements for perfecting appeal by failing to serve copy of praecipe for record upon plaintiff or his attorney (Ill. Rev. Stat. 1947, ch. 110, par. 259.36; Jones Ill. Stats. Ann. 105.36).

Appeal from the County Court of La Salle county; the Hon. JOHN J. MASSIEON, Judge, presiding.

Judgment affirmed. Heard in this court at the October term, 1948.
