Appellant Cedric Moore, proceeding pro se, filed a notice of appeal of the trial court's Final Judgment, signed on June 27, 2023. See Tex. R. App. P. 26.1. The record was due on August 28, 2023. See Tex. R. App. P. 35.1. On August 9, 2023, the clerk's record was filed. The reporter's record has not been filed.
On August 28, 2023, the Clerk notified Appellant that the court reporter responsible for preparing the record informed the Court that Appellant had not requested preparation of the record, and the Court might consider and decide only those issues or points that do not require a reporter's record. See Tex. R. App. P. 37.3(c). On March 4, 2024, the Clerk of this Court confirmed that Appellant is permitted to proceed on appeal without payment of costs. See Tex. R. Civ. P. 145(a); Tex.R.App.P. 20.1. On June 25, 2024, this Court ordered Appellant to submit a request to the court reporter to prepare the record, with the fee waived, within seven days of the date of the order. On July 31, 2024, the court reporter filed an Information Sheet, indicating that Appellant has not requested preparation of the reporter's record. Accordingly, the Court will consider and decide those issues or points on appeal that do not require a reporter's record for a decision. See id.
Appellant's brief is ORDERED to be filed within 30 days of the date of this order. See Tex. R. App. P. 38.6(a). Appellee's brief, if any, is ORDERED to be filed within 30 days of the filing of Appellant's brief. See Tex. R. App. P. 38.6(b).
