This case was scheduled to be tried at the Court's February 16, 2021, Birmingham, Alabama, remote trial session. By Order served February 8, 2021, the Court struck the case from that trial session, and the undersigned judge retained jurisdiction. On November 4, 2021, the Court held a conference call with the parties to discuss the current status of the case. Based on that discussion and upon due consideration, it is hereby
