MEMORANDUM OPINION


This appeal was abated on August 7, 2003 due to the filing of bankruptcy by appellant Gary Stephen Moore. See Tex. R. App. P. 8.2. By letter dated June 7, 2010, the Court directed the parties to notify us of the status of the bankruptcy proceedings. In response, appellant's counsel filed a letter stating appellant successfully completed his plan under the Bankruptcy Code and has been discharged of all of his debts incurred prior to his filing, including any liability related to this case. Therefore, counsel states the appeal should be dismissed. We will treat the letter as a motion to dismiss the appeal, and, as such, we grant the motion. We dismiss the appeal.
