MOORE a/k/a WILLIAMS v. STATE

District Court of Appeal of Florida, Second District
Jul 12, 2000
No. 2D96-3595 (Fla. Dist. Ct. App. Jul. 12, 2000)

Opinion

No. 2D96-3595.

Opinion filed July 12, 2000.

Appeal from the Circuit Court for Hillsborough County; M. William Graybill, (Senior) Judge.

James Marion Moorman, Public Defender and Richard J. Sanders, Assistant Public Defender, Bartow, for Appellant.

Robert A. Butterworth, Attorney General, Tallahassee and Tonja R. Vickers, Assistant Attorney General, Tampa, for Appellee.

Appellant challenges his judgment and sentence imposed for an offense which occurred on October 30, 1995. We find possible error only in regard to appellant's sentence, as it was imposed pursuant to the 1995 sentencing guidelines. Thus, we remand this case to the trial court for reconsideration of the sentence imposed. See Smith v. State, 25 Fla. L. Weekly D1273 (Fla. 2d DCA May 24, 2000).

Affirmed; remanded for reconsideration.

CAMPBELL, A.C.J., and THREADGILL and FULMER, JJ., Concur.
