DECISION AND ORDER ON MOTION

Motion to strike appellant's brief and for leave to apply for counsel fees.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion to strike the appellant's brief is granted, without costs, to the extent that those portions of the appellant's brief that reference the papers filed in support of appellant's motion for a stay pending appeal are hereby deemed stricken, and it is further

ORDERED that the motion for leave to apply for counsel fees is denied, without costs.
