Steve F. MONTOYA, Jr., M.D., West Texas Renal Care and West Texas Nephrology, Appellants v. Kirk BREWER, M.D., Appellee

MEMORANDUM OPINION

From the 119th District Court, Tom Green County, Texas
Trial Court No. B-15-0285-C
Honorable Ben Woodward, Judge Presiding PER CURIAM Sitting: Sandee Bryan Marion, Chief Justice Karen Angelini, Justice Jason Pulliam, Justice DISMISSED FOR LACK OF JURISDICTION

From our initial review of the record in this interlocutory appeal it appeared this court lacks jurisdiction because the trial court's order granting appellee's motion to dismiss did not dispose of all parties and asserted causes of action. Therefore, on April 27, 2016, this court ordered appellant to show cause in writing by May 9, 2016 why this appeal should not be dismissed for lack of jurisdiction. Appellant has not responded.

Therefore, this appeal is dismissed for lack of jurisdiction. See TEX. R. APP. P. 42.3(a). Costs of appeal are taxed against appellant.
