Based upon the Stipulation and Joint Motion for Dismissal with Prejudice submitted by Barbara Montgomery ("Plaintiff") and Granite Construction Company ("Defendant"), and for good cause appearing:

IT IS HEREBY ORDERED that all claims and causes of action of Plaintiff against all Defendants are hereby DISMISSED WITH PREJUDICE and on the merits, each party to bear its own costs, expenses and attorneys' fees.
