This case is calendared for trial at the September 6, 2022, Birmingham, Alabama remote Trial Session of the Court. On June 28, 2022, respondent notified the Court that petitioner, Kim Montgomery, filed a petition with the United States Bankruptcy Court for the Northern District of Alabama under 11 U.S.C. Chapter13 on April 8, 2022. Upon due consideration, it is

ORDERED that this case is stricken for trial from the Court's September 6, 2022, Birmingham, Alabama trial session. It is further

ORDERED that pursuant to 11 U.S.C. Section 362 (a) (8), all proceedings, as to petitioner, Kim Montgomery, are automatically stayed. It is further

ORDERED that, although all proceedings are stayed, the parties shall on or before January 9, 2023, file with the Court a report as to the then present status of the bankruptcy proceeding. 1
