ORDER MODIFYING

THE COURT:

It is ordered that the opinion filed herein on September 28, 2011, be modified as follows:

On page 2, the third sentence of the second full paragraph that reads, "The lease states that it is subject to the CC&R’s and that lessees acknowledge receipt of them" is deleted and the following sentence is inserted in its place:

The lease states that "Lessee acknowledges receipt of [the CCR&Rs], " and that "any rights of Lessees thereunder are subordinate to the rights of Lessor."

There is no change in the judgment.
