    The Court clearly contemplated that actual damages on remand would still be trebled. Montello v. Smith, 39 Mass. App. Ct. 1120 (1995). On remand, damages were apparently assessed after hearing under the "benefit of the bargain" rule by which a plaintiff is awarded "the difference between the value of what he [had] received and the actual value of what he would have received if the representations had been true."
