          ORDER ACCEPTING REPORT AND AND RECOMMENDATION OF UNITED STATES MAGISTRATE JUDGE

          GEORGE H. KING, Chief United States District Judge.

         Pursuant to 28 U.S.C. § 636, the Court has reviewed the entire record in this action and the Report and Recommendation of the United States Magistrate Judge. No written objections to the Report and Recommendation have been received. The Court accepts the findings and recommendation of the Magistrate Judge.

         IT IS THEREFORE ORDERED: (1) that judgment be entered dismissing this action, without prejudice, for failure to prosecute; and (2) denying as moot Defendant Rosales's motion to compel, etc. (docket no. 21, filed December 30, 2014).

         JUDGMENT

         IT IS ADJUDGED that this action is dismissed, without prejudice, for failure to prosecute.
