RULING

ACCORDINGLY, Plaintiff's Motion for Cross-Summary Judgment ⁴ is DENIED; Defendant, Dr. Jonathan Roundtree's Motion for Summary Judgment ⁵ is GRANTED, and this action shall be dismissed.
