On Writ of Certiorari to the Court of Appeal, Second Circuit, Parish of Ouachita
PER CURIAM
Granted. Because La. R.S. 33:2501(E)(1) vests appellate jurisdiction in the district court, the court of appeal lacks appellate jurisdiction over this matter. See Miazza v. City of Mandeville, 10-0304 (La. 5/21/10), 34 So.3d 84; Caire v. Stassi, 379 So.2d 1056 (La. 1980).
Accordingly, the judgment of the court of appeal directing the district court to grant a suspensive appeal to the court of appeal is reversed. The case is remanded to the court of appeal to consider defendant's application on the merits pursuant to its supervisory authority under La. Const. Art. V, §10.
