Intervenor-respondent having applied for permission to proceed as a poor person and for assignment of counsel on the appeal taken herein from an order of the Family Court, Monroe County, entered in the Office of the Clerk of said Court on December 9, 2013,

Now, upon reading and filing the certification of Kathleen P. Reardon, Esq., dated March 11, 2014, and due deliberation having been had thereon,

It is hereby ORDERED that the application is granted, and

It is further ORDERED that Charles T. Noce, Esq., Monroe County Conflict Defender, 80 West Main Street, Suite 300, Rochester, New York 14614, is hereby assigned as counsel for intervenor-respondent herein and may submit ten copies of respondent's brief reproduced in accordance with CPLR 5529, and

It is further ORDERED that counsel is assigned to respond to the appeal consistent with the limitations set forth in Family Court Act § 1035 (d).
