Monds v. State

District Court of Appeal of Florida, Fourth District
May 3, 2000
756 So. 2d 1093 (Fla. Dist. Ct. App. 2000)

Opinion

No. 4D00-0284.

Opinion filed May 3, 2000.

Appeal of order denying rule 3.850 motion from the Circuit Court for the Fifteenth Judicial Circuit, Palm Beach County; John L. Phillips, Judge; L.T. No. 97-7655CFA02.

Terrell Monds, Okeechobee, pro se.

Robert A. Butterworth, Attorney General, Tallahassee, and Georgina Jimenez-Orosa, Assistant Attorney General, West Palm Beach, for appellee.

This is an appeal from a summary denial of a Rule 3.850 motion. Because the trial court denied the facially sufficient motion without attaching portions of the record to conclusively refute appellant's claims, we reverse and remand for such attachments or for an evidentiary hearing on the motion.

FARMER, STEVENSON and GROSS, JJ., concur.
