This case is presently calendared for trial at the Court's November 14, 2022, standalone remote trial session. On September 28, 2022, respondent filed a Motion to Dismiss for Lack of Prosecution. In the motion, respondent states that petitioner has been nonresponsive to his communication attempts to resolve this case.
Upon due consideration of respondent's motion and for cause, it is
ORDERED that, on or before November 4, 2022, petitioner shall file an objection, if any, to respondent's Motion to Dismiss for Lack of Prosecution, filed September 28, 2022. Failure to file an objection may result in the Court granting respondent's motion. It is further
ORDERED that respondent's Motion to Dismiss for Lack of Prosecution is set for hearing at the calendar call of the Court's November 14, 2022, standalone remote trial session beginning 1:00 P.M. (Eastern Time). The parties may refer to the Notice of Remote Proceeding for additional details.
