MOMENTUM CONTRACTORS, INC., FREDERICK ALLEN, JR. & JUDY ALLEN, Appellant v. TRI-TEMP REFRIGERATION, INC., Appellee

On Appeal from the 125th District Court Harris County, Texas
Trial Court Cause No. 2012-19727

MEMORANDUM OPINION

This is an appeal from a judgment signed April 3, 2013. On December 5, 2013, this court abated this appeal because appellants Frederick Allen, Jr. and Judy Allen petitioned for voluntary bankruptcy in the United States Bankruptcy Court for the Southern District of Texas, under cause number 13-37143. See Tex. R. App. P. 8.2.

Through the Public Access to Court Electronic Records (PACER) system, the court has learned that the bankruptcy case was closed January 22, 2016.

On March 14, 2017, this court issued an order stating that the appeal would be reinstated and dismissed for want of prosecution unless, on or before April 3, 2017, a party to the appeal filed a motion demonstrating good cause to retain this appeal. No response was filed.

Accordingly, we reinstate the appeal and order it dismissed.

PER CURIAM Panel consists of Chief Justice Frost and Justices Donovan and Wise.
