Appeal from the County Court at Law No. 3 of El Paso County, Texas (TC# 2013-CCV02705) ORDER
On January 13, 2015, Appellant filed a motion for mediation referral with "Jose Rocha and/or the El Paso County Dispute Resolution Center." On January 27, 2015, we granted the motion and specifically ordered the case referred to "Jose Rocha or another qualified mediator agreed upon by the parties." Based upon information Appellant has provided to the Court, it appears Appellant has pursued mediation with Mr. Rocha and mediation is scheduled for March 3, 2015, but he has also spoken with the El Paso County Dispute Resolution Center about scheduling mediation with the DRC after March 3, 2015. Mr. Rocha and Mr. Radames Sanchez of the El Paso County Dispute Resolution Center have both contacted the Clerk's Office and requested clarification of our prior order.
In the event our prior order has been misunderstood, we now clarify that the Court did not order, and did not intend to order, the case referred to the El Paso County Dispute Resolution Center. We instead ordered the case referred to "Jose Rocha or another qualified mediator agreed upon by the parties." If the parties wish to mediate before someone other than Mr. Rocha, the order permits it provided Appellant and Appellee agree upon that mediator, which could of course include the El Paso County Dispute Resolution Center. The deadlines established by the January 27, 2015 order remain in place.
