Moed, Inc. v. Wash & Dry, Inc.

District Court of Appeal of Florida, Third District
Nov 8, 1983
440 So. 2d 609 (Fla. Dist. Ct. App. 1983)

Opinion

No. 83-598.

November 8, 1983.

Appeal from Circuit Court, Dade County; Leonard Rivkind, Judge.

John Kirk McDonald, Claudia B. Greenberg, Coral Gables, for appellant.

Richard D. Katz, Coral Gables, for appellee.

Before HENDRY, BASKIN and FERGUSON, JJ.

Appellant, defendant below, raises several issues for review, only one of which was both an issue in the trial court and adequately preserved for review, i.e., whether it should have been relieved of its duty to perform according to the terms of a written agreement because of appellee's alleged nonperformance. There is sufficient evidence in the record to support the jury's verdict in favor of appellee.

Affirmed.
