MMM 410 BAR AND GRILL, LLC, Appellant v. Jose FONG, Ericka Fong, Loop 410 Development, LTD Co., and EFJFM, LLC, Appellees
From the 408th Judicial District Court, Bexar County, Texas
Trial Court No. 2018CI01524
Honorable Cathleen M. Stryker, Judge Presiding
ORDER
The clerk's record in this appeal has been filed. It reflects that on March 13, 2018, Appellant MMM 410 Bar and Grill, LLC d/b/a Trophies filed a notice of appeal stating its desire to appeal from the trial court's order denying appellant's request for a temporary injunction. Appellant represented in its notice of appeal that the trial court's order was signed February 22, 2018. However, there is no such signed order by the trial court included in the clerk's record. "Judge's Notes," which are dated February 22, 2018, reflect that "Plaintiff's Request for Temporary Injunction is Denied." "A judge's handwritten notes are for his or her own convenience and form no part of the record." In re L.H., No. 04-13-00174-CV, 2013 WL 3804585, at *1 (Tex. App.—San Antonio July 17, 2013, no pet.) (mem. op.) (citing In re A.W., 384 S.W.3d 872, 873 (Tex. App.—San Antonio 2012, no pet.)). In other words, judge's notes do not constitute an appealable order. See id. We therefore ORDER appellant to show cause on or before May 14, 2018 why this appeal should not be dismissed for lack of jurisdiction.
