ORDER DENYING MOTION FOR RECONSIDERATION OF 6/12/08 ORDER DENYING 5/30/08 MOTION FOR RECUSAL
Upon consideration of the "Motion for Reconsideration of 6/12/08 Order Denying 5/30/08 Motion for Recusal" filed by Defendant-Appellant Glenn Kiyohiko Mizukami (Appellant) on June 20, 2008, the papers in support, and the records and files herein, it appears that: (1) Appellant is seeking reconsideration of the June 12, 2008 order denying Appellant's motion to recuse Associate Judges Corinne Watanabe and Daniel Foley from this appeal; (2) pursuant to Rule 40(b) of the Hawai'i Rules of Appellate Procedure (HRAP), the party moving for reconsideration must show that the court overlooked or misapprehended points of law or fact; and (3) Appellant fails to show that the court overlooked or misapprehended any points of law or fact and he fails to show that recusal or disqualification is warranted. See Ross, 89 Hawai'i 371, 974 P.2d 11 (1998). Accordingly,
IT IS HEREBY ORDERED that the motion for reconsideration is denied.
