Mizani v. State

Supreme Court of Florida
Sep 28, 1978
406 So. 2d 49 (Fla. 1978)

Opinion

No. 54306.

September 28, 1978.

Appeal from Circuit Court, Leon County; John A. Rudd, Judge.

Stephen Lindsey Gorman and Sidney L. Matthew, Tallahassee, for appellants.

Robert L. Shevin, Atty. Gen. and Raymond L. Marky, Asst. Atty. Gen., Tallahassee, for appellee.

In light of our recent decision in State v. Allen, 362 So.2d 10 (Fla. 1978), this case presents no colorable constitutional issue, and it is, therefore, transferred to the District Court of Appeal, First District, for consideration of the remaining points raised by the appellants.

It is so ordered.

ENGLAND, C.J., and ADKINS, BOYD, OVERTON, SUNDBERG, HATCHETT and ALDERMAN, JJ., concur.
