Case No. 3:17cv110-LC-CJK
05-23-2017
REPORT AND RECOMMENDATION
On March 30, 2017, the court ordered plaintiff to submit the initial partial filing fee of $11.66 within 30 days. (Doc. 6). Plaintiff failed to comply with the order within the allotted time. On May 4, 2017, the court directed plaintiff to show cause within 14 days why this case should not be dismissed due to his failure to prosecute and/or failure to comply with an order of the court. (Doc. 9). To date, plaintiff has not paid the initial partial filing fee or responded to the May 4 show cause order.
Accordingly, it is respectfully RECOMMENDED:
1. That this case be DISMISSED WITHOUT PREJUDICE due to plaintiff's failure to prosecute and/or failure to comply with an order of the court.
2. That the clerk be directed to close the file.
At Pensacola, Florida, this 23rd day of May, 2017.
