ARIES MITCHELL, Appellant v. DAVID BARGINEAR, Appellee

On Appeal from the County Court at Law No. 1 Dallas County, Texas Trial Court Cause No. CC-23-07940-A.

ORDER

CORY L. CARLYLE, JUSTICE.

Before the Court is appellant's August 13, 2024 third motion for an extension of time to file her opening brief. We GRANT the motion and extend the time to August 30, 2024. We caution appellant that failure to file a brief on or before August 30, 2024 may result in dismissal of the appeal for want of prosecution without further notice. See Tex. R. App. P. 38.8(a)(1).

We note that the name Robert Mullins appears under appellant's name on the signature line and the medical records attached concern Mr. Mullins. Aries Mitchell is the only person who filed a notice of appeal and she is the only appellant before the Court.

Also before the Court is appellee's August 13, 2024 amended motion to dismiss the appeal for want of prosecution. We DENY the motion.
