Appeal from the 175th District Court of Bexar County, Texas (TC# 2022-CR-7795)

ORDER

PER CURIAM

On October 30, 2023, Patrick Ballantyne Jr., Appellant's retained attorney, filed a motion to withdraw from representation. However, before the Court considers the motion it will be necessary for the trial court to conduct a hearing.

Therefore, the case is abated, and the Court ORDERS the trial court to conduct a hearing and rule on the motion to withdraw. If the motion is granted, the trial court shall determine if the appellant has retained new counsel or is entitled to court-appointed counsel. If Appellant is entitled to court-appointed counsel, the trial court is directed to appoint new appellate counsel.

The trial court shall forward its order and/or findings to the District Clerk of Bexar County on or before December 27, 2023. The District Clerk shall prepare a supplemental clerk's record containing the trial court's order and or findings on or before January 6, 2024. Further, the transcription of the hearing shall be prepared, certified and filed with this Court on or before January 6, 2024.

The case shall be abated until January 6, 2024, or the supplemental clerk's record is received whichever occurs first.
