Oscar MIRELES, Appellant v. THE STATE OF TEXAS, Appellee
From the County Court at Law No. 8, Bexar County, Texas
Trial Court No. 367739
The Honorable Liza Rodriguez, Judge Presiding
ORDER
On October 17, 2013, appellant filed what he claims is his first motion for extension of time to file his appellant's brief. We advise appellant that this is actually his second motion to extend time to file his brief. Appellant's brief was originally due August 21, 2013, but neither the brief nor an extension of time to file the brief was filed. Accordingly, we sent appellant a notice pursuant to Rule 38.8 of the Texas Rules of Appellate Procedure, advising appellant the brief was overdue, and instructing him to file the brief or a motion to extend time to file the brief. In response, on September 18, 2013, appellant filed a motion to extend time to file the brief, asking for an additional sixty days from the original due date to file the brief. We granted appellant's motion and ordered him to file his brief on or before October 18, 2013. Accordingly, the motion before this court is a second motion in which appellant is asking for an additional sixty days to file his brief. We grant the motion in part, and deny the motion in part. We grant appellant an additional thirty days to file his brief. Accordingly, appellant is ordered to file his brief on or before November 18, 2013. Appellant is advised that no further extensions of time to file his brief will be granted absent written proof of extraordinary circumstances. Appellant is further advised that a lack of experience with regard to the law is not an extraordinary circumstance, and neither is a busy schedule.
