This case is currently calendared for trial at the Court's San Diego, California trial session, scheduled for a date and time certain of Thursday, June 22, 2023, at 10:00 a.m.
On June 2, 2023, the Commissioner filed a motion for leave to file first amendment to first amended answer. Also on the same day, the Commissioner filed the first amendment to first amended answer. The first amendment to first amended answer should have been lodged and not filed. The Court will direct petitioners Kevin J. Mirch and Marie C. Mirch to file a response to the motion. Accordingly, it is
ORDERED that the Clerk of the Court shall (1) change the docket entry for the Commissioner's first amendment to first amended answer, filed June 2, 2023, to reflect that the document was lodged on June 2, 2023, and (2) add a cover page to the Commissioner's first amendment to first amended answer that bears an eLodged stamp of June 2, 2023. ORDERED that, on or before June 9, 2023, the Mirches shall file a response to the Commissioner's motion for leave to file first amendment to first amended answer.
