This case is currently calendared for trial on the Court's San Diego, California trial session, scheduled to begin the week of June 20, 2023.
On May 5, 2023, the parties filed a joint motion requesting a continuance of trial to a later point during the Court's Spring term, or, in lieu of a continuance, the extension of certain filing deadlines. We will deny the continuance. The parties supply no adequate justification for their request, and, in any event, the trial already is scheduled for the final two days of the Spring term. The parties have provided sufficient reasons for their extension request, and the Court will accordingly grant that relief. Upon due consideration, it is
ORDERED that the joint motion for continuance is denied in part in that this case will remain set for trial at the above-referenced calendar at the date and time certain as previously set in the Court's Order served March 29, 2023 and granted in part in that the deadlines for various filings will be extended as detailed below. It is further
ORDERED that the due date for the Mirches to complete the portions of the form attached to the March 29, 2023 Order that relate to their positions as to substantiation and file it as a status report in DAWSON is extended until May 23, 2023. It is further
ORDERED that the due date for the Commissioner to file a response to the Mirches' status report in which he completes those portions of the substantiation form related to his positions is extended until June 6, 2023. It is further
ORDERED that the due date for the Mirches to file a response to the Commissioner's motion for partial summary judgment is extended until June 6, 2023.
