Minzey v. Shapiro

District Court of Appeal of Florida, Fourth District
Sep 15, 1977
349 So. 2d 182 (Fla. Dist. Ct. App. 1977)

Opinion

No. 76-372.

June 17, 1977. Rehearing Denied September 15, 1977.

Appeal from Circuit Court, Broward County; Martin Sack, Judge.

Kathleen B. Johnson of Law Offices of Norman F. Solomon, Miami, for appellants.

Arnold R. Ginsberg of Horton, Perse Ginsberg, and H. Lawrence Asher, Miami, for appellee.

We find that there is a genuine issue of material fact concerning the affirmative defense of usury raised by the appellants, Richard F. Minzey and Jo Ann Minzey, precluding the entry of summary judgment. Accordingly, the judgment is reversed and the cause is remanded for further proceedings consistent herewith.

ALDERMAN, ANSTEAD and DAUKSCH, JJ., concur.
