BARRY DWAYNE MINNFEE, APPELLANT v. THE STATE OF TEXAS, APPELLEE

ORDER OF DISMISSAL

MEMORANDUM OPINION

Before QUINN, C.J., and PIRTLE and PARKER, JJ.

Barry Dwayne Minnfee, proceeding pro se, filed a "Special Notice of Appeal" with the clerk of this court on October 11, 2017. However, the notice did not sufficiently show Minnfee's desire to appeal from a judgment or appealable order. See TEX. R. APP. P. 25.2(c)(2). On October 16, 2017, we directed Minnfee to amend his notice of appeal to comport with appellate rule 25.2(c)(2), by identifying the judgment or order from which appeal is sought, and to explain why this court has jurisdiction over the appeal by October 30. See id. Minnfee did not file a response to the court's letter.

Our jurisdiction is dependent upon the existence of a judgment or appealable order. Palomo v. State, 330 S.W.3d 920, 920-21 (Tex. App.—Amarillo 2010, no pet.). As Minnfee has not presented either to this court, we lack jurisdiction over the appeal.

The appeal is dismissed for want of jurisdiction.
